1. General ambit
   We deliver solely on the basis of the following general delivery and trading conditions. These sales conditions are a component of each completed contract. Individual contract agreements require the written form. Avenging Animal/AVE is at any time entitled to change or supplement these general trading conditions including all possible enclosures with an appropriate term of notice. Still pending orders will be handled after the then still valid old general trading conditions.
   
2. Offer, order, conclusion of a contract
   Our offers apply without obligation and are not-binding. Orders are accepted over our order system, over the Shop Hotline as well as in written form, by fax or by email. Orders can be considered as accepted, as far as we confirmed these or brought the commodity to the distribution. For accepted orders we assure prompt and careful completion. The supply is carried out on basis of the in each respective case valid price list of the On-line Shop.
   
3. Supply, transfer of perils on dispatch
   Supplies take place via our respective logistics partners. The supply is carried out on danger of the receiver. The customer commits itself to accept the ordered commodity within the prescribed period. It remains reserved to us to make a partial delivery if this appears favourable for a brisk completion. Possible customer-desired special dispatching forms are computed with local addition.
   
4. Prizes
   All quotations comprise the inclusive legally valid value-added tax
   
5. Payment
   In the case of not differently agreed upon, the following payment means are accepted:
   
   • direct debit after direct debit authorization of the customer
   • prepayment by transfer or (the dispatch of the commodity takes place immediately after credit note of the invoice amount on our account)
   • cash on delivery (the invoice amount will be encashed while delivery)
     Delay of payment is computed with 5% over the respective basis interest rate
     
6. Retention of title
   The supplied commodity remains our property up to complete payment.
7. Return
   We guarantee a return right of 14 days for not used commodity. The return period is protected by mailing within the prescribed period of the commodity (invoice date). The return is only accepted by us if it is sufficiently franked.
8. Warrantee
   The customer has to query deficiencies of the commodity supplied by AVE within 48 hours after supply. Visible deficiencies or shortfalls have to be acknowledged by delivery of the incoming good and require an immediate report to us.
9. Data handling
   In accordance with § 28 of the Federal Law for Data Protection (BDSG) we make attentive to the fact that in the context of the customer/delivery deal the necessary data are processed and stored by means of an EDP medium in accordance with § 33 (BDSG). Personal data are as a matter of course confidentially treated.
10. Place of Delivery and Area of Jurisdiction
    Place of delivery for good deliveries is 92521 Schwarzenfeld.
    Area of jurisdiction is the court responsible for Schwarzenfeld.
